These Terms & Conditions (\u201cTerms\u201d) govern your use of the Platinum Filmz website and your purchase or use of services provided by Platinum Filmz LLC (\u201cPlatinum Filmz,\u201d \u201cwe,\u201d \u201cus,\u201d or \u201cour\u201d). By using our website or purchasing our services, you agree to these Terms.<\/p>\n\n

1. Services<\/strong><\/p>\n\n

Platinum Filmz provides film, television, digital media, marketing, advertising, social media management, content creation, and related business services.<\/p>\n

For clients purchasing a service plan or subscription, the specific services, deliverables, features, pricing, and billing frequency are determined by the service plan selected by the client at the time of purchase. The selected service plan and its description presented at checkout are incorporated into and form part of these Terms.<\/p>\n

Services outside the scope of the selected plan are not included unless separately agreed to in writing by Platinum Filmz and the client.<\/p>\n\n

2. Payments and Subscription Services<\/strong><\/p>\n\n

Certain services may require an initial setup fee and recurring monthly subscription payments. Prices, billing frequency, and included services will be disclosed before purchase.<\/p>\n\n

By purchasing a recurring service, you authorize the applicable payment processor to charge the payment method you provide according to the billing schedule associated with your selected plan.<\/p>\n\n

3. Setup Fees<\/strong><\/p>\n\n

When applicable, setup fees cover initial onboarding, account preparation, strategy, configuration, creative setup, and other work necessary to begin providing services.<\/p>\n\n

Unless otherwise required by law or stated in a separate written agreement, setup fees are non-refundable once onboarding or setup work has begun.<\/p>\n\n

4. Recurring Billing<\/strong><\/p>\n\n

Subscription services will continue to renew according to the billing schedule selected at purchase until canceled in accordance with these Terms or a separate written agreement.<\/p>\n\n

Clients are responsible for maintaining a valid payment method.<\/p>\n\n

5. Cancellation<\/strong><\/p>\n\n

Clients may cancel recurring services at any time by submitting a cancellation request to Platinum Filmz through the designated customer support email or other cancellation method provided by Platinum Filmz.<\/p>\n

Cancellation will stop future recurring charges and will become effective at the end of the client’s current paid billing period. Unless otherwise required by applicable law, payments already made for the current billing period are non-refundable and will not be prorated.<\/p>\n

Platinum Filmz will continue providing the services included in the client’s selected plan through the end of the current paid billing period, provided the client’s account remains in good standing.<\/p>\n

Cancellation of recurring services does not relieve the client of responsibility for any outstanding amounts already due or charges incurred before the cancellation becomes effective.<\/p>\n

Platinum Filmz may suspend or terminate services for nonpayment, fraudulent or unlawful activity, material violation of these Terms, misuse of services, or failure to provide information, access, approvals, or materials reasonably necessary to perform the services.<\/p>\n

6. Refunds<\/strong><\/p>\n\n

Payments for completed work, setup services, and services already rendered are generally non-refundable except where required by law or specifically provided in a separate written agreement.<\/p>\n\n

Any approved refund will be handled according to the circumstances of the transaction and the applicable payment processor’s procedures.<\/p>\n\n

7. Client Responsibilities<\/strong><\/p>\n\n

Clients agree to provide accurate information and any materials, approvals, account access, content, branding, or other resources reasonably required for Platinum Filmz to perform the purchased services.<\/p>\n\n

Delays in providing required information, approvals, or materials may affect delivery schedules and results.<\/p>\n\n

8. Results<\/strong><\/p>\n\n

Platinum Filmz will use reasonable professional efforts to provide the services purchased. However, marketing, advertising, social media, audience growth, sales, revenue, engagement, and other business results can be affected by factors outside our control.<\/p>\n\n

Therefore, we do not guarantee any specific number of followers, views, leads, customers, sales, revenue, or other business outcome unless expressly stated in a separate written agreement.<\/p>\n\n

9. Intellectual Property<\/strong><\/p>\n\n

Platinum Filmz retains all rights, title, and interest in its pre-existing intellectual property, proprietary systems, methods, workflows, processes, templates, designs, software, production techniques, know-how, source files, project files, and other materials developed or owned by Platinum Filmz independently of a client’s specific project.<\/p>\n

Upon full payment of all amounts due for the applicable services, the client receives the right to use final custom content specifically created and delivered to the client as part of the purchased service plan for the client’s business, marketing, advertising, and social media purposes.<\/p>\n

Unless expressly agreed otherwise in writing, the transfer or permitted use of final deliverables does not include Platinum Filmz’s underlying templates, working files, project files, proprietary processes, systems, methods, or other production assets used to create those deliverables.<\/p>\n

The client represents that it has the necessary rights and permissions to use any logos, photographs, videos, music, trademarks, written materials, account information, or other content supplied to Platinum Filmz for use in providing the services.<\/p>\n\n

10. Acceptable Use<\/strong><\/p>\n\n

You agree not to misuse our website or services, attempt unauthorized access to our systems, interfere with website operation, engage in fraudulent activity, or use our services for unlawful purposes.<\/p>\n\n

11. Third-Party Services<\/strong><\/p>\n\n

Our services may use or integrate with third-party platforms, payment processors, social networks, software providers, hosting companies, or other services. Platinum Filmz does not control and is not responsible for changes, interruptions, policies, or actions of independent third-party services.<\/p>\n\n

12. Limitation of Liability<\/strong><\/p>\n\n

To the fullest extent permitted by applicable law, Platinum Filmz will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of our website or services.<\/p>\n\n

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law.<\/p>\n\n

13. Privacy<\/strong><\/p>\n\n

Your use of our website and services is also subject to our Privacy Policy.<\/p>\n\n

14. Changes to These Terms<\/strong><\/p>\n\n

We may update these Terms periodically. When changes are made, we may update the effective date displayed at the top of this page.<\/p>\n\n

15. Governing Law<\/strong><\/p>\n\n

These Terms will be governed by the laws of the State of Arkansas, without regard to conflict-of-law principles, except where applicable law requires otherwise.<\/p>\n\n
